Agreement to Terms

By accessing or using Go Fish ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Platform.

Go Fish is a platform that connects Maine's fishing community, specifically captains seeking crew members and crew seeking work opportunities in the maritime fishing industry.

User Accounts and Registration

Account Creation

  • You must provide accurate and complete information when creating your account
  • You must be at least 18 years old to use this Platform
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized use of your account

Profile Information

  • Captains must provide accurate vessel and licensing information
  • Crew members must provide truthful experience and qualification details
  • False or misleading information may result in account suspension or termination
  • You consent to sharing contact information for job matching purposes as specified in your profile settings
Platform Use and Conduct

Acceptable Use

You agree to use the Platform in accordance with all applicable laws and regulations. You may:

  • Create and maintain accurate profiles
  • Post legitimate job opportunities (captains) or apply for jobs (crew)
  • Communicate respectfully with other users
  • Report suspicious or inappropriate behavior

Prohibited Activities

You agree not to:

  • Post false, misleading, or fraudulent job listings or profile information
  • Harass, threaten, or discriminate against other users
  • Use the Platform for any illegal activities
  • Attempt to circumvent Platform fees or payment systems
  • Scrape, copy, or misuse Platform data or content
  • Create multiple accounts or use automated systems
  • Share contact information outside of accepted job offers or applications
Job Postings and Applications

Captain Responsibilities

  • Job postings must be accurate, legal, and for legitimate fishing positions
  • Compensation and working conditions must be clearly stated
  • You must comply with all maritime labor laws and safety regulations
  • You are responsible for verifying crew qualifications and certifications
  • Jobs must be removed when positions are filled

Crew Responsibilities

  • Applications must contain truthful information about experience and qualifications
  • You must possess any required licenses, certifications, or permits
  • You are responsible for your own safety and following vessel safety protocols
  • Professional conduct is expected in all interactions
Employment Relationships

Platform Role: Go Fish is a marketplace platform only. We do not:

  • Enter into employment relationships with users
  • Act as an employer, employee, or employment agency
  • Control the terms of employment between captains and crew
  • Guarantee job placement or employment outcomes
  • Provide worker's compensation, insurance, or benefits

User Responsibility: All employment relationships, contracts, and working arrangements are solely between captains and crew members. Users are responsible for:

  • Negotiating terms of employment directly
  • Ensuring compliance with labor laws and maritime regulations
  • Obtaining appropriate insurance coverage
  • Handling payroll, taxes, and employment documentation
Safety and Maritime Compliance

Working in the fishing industry involves inherent risks. Users acknowledge:

  • Go Fish does not verify vessel safety conditions or captain qualifications
  • Crew members are responsible for assessing workplace safety
  • All users must comply with US Coast Guard regulations and state fishing laws
  • Proper safety equipment and training are the responsibility of vessel operators
  • Users should verify insurance coverage before beginning work
Platform Fees and Payments

Go Fish may charge fees for premium features or services. Current fee structures include:

  • Basic platform use is currently free
  • Premium features may be introduced with advance notice
  • All employment compensation is handled directly between captains and crew
  • We do not process or hold employment payments
Intellectual Property

The Platform and its content are owned by Go Fish and protected by intellectual property laws. Users retain rights to their profile content but grant us license to use it for Platform operations.

  • You retain ownership of content you post
  • You grant us a non-exclusive license to display and use your content on the Platform
  • You may not use our trademarks or branding without permission
  • We respect intellectual property rights and respond to valid DMCA notices
Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, incorporated by reference into these Terms, governs how we collect, use, and protect your information. By using the Platform, you consent to data collection and use as described in our Privacy Policy.

Disclaimers and Limitation of Liability

Platform Disclaimer

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GO FISH SHALL NOT BE LIABLE FOR:

  • Workplace injuries or accidents occurring during fishing activities
  • Employment disputes between captains and crew
  • Loss of income or business opportunities
  • Damages arising from user interactions or employment relationships
  • Indirect, incidental, or consequential damages

Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Go Fish from any claims, damages, or expenses arising from:

  • Your use of the Platform
  • Your employment relationships or business dealings
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Any content you post or share
Dispute Resolution

Informal Resolution

Before initiating formal proceedings, parties agree to attempt good faith resolution through direct communication.

Governing Law

These Terms are governed by the laws of the State of Maine, without regard to conflict of law principles. Any legal proceedings must be brought in the state or federal courts of Maine.

Arbitration

For disputes involving amounts over $10,000, parties may agree to binding arbitration under the rules of the American Arbitration Association.

Platform Modifications and Termination

Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with reasonable notice.

Account Termination

We may suspend or terminate accounts for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of other users
  • Extended inactivity

Users may delete their accounts at any time through their profile settings.

General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Go Fish.

Severability

If any provision is found unenforceable, the remaining provisions will continue in full force and effect.

Updates to Terms

We may update these Terms periodically. Material changes will be communicated through the Platform or by email. Continued use after changes constitutes acceptance of new Terms.
